Definition and object of the contract

The present contract is governed by Legislative Decree No. 206/2005 (Consumer Code) and subsequent amendments. The contract concerns the sale of cosmetic products from perfumery and textiles between Ligyes srl (seller), located in Genoa, Piazza delle Vigne ⅜, tax code and VAT number 02893200994, and the consumer (the customer).

It is the customer’s obligation to read and expressly accept these terms and privacy policy before proceeding with the order confirmation. The terms published on the website at the time of the order apply.

PROTECTION OF INDUSTRIAL AND INTELLECTUAL PROPERTY

No trademark reproduced here from Ligyes srl may be used as a link or for any other use, including advertising, without prior written consent from Ligyes srl.

Purchase and Payment Methods and Prices

Purchases are made through the e-commerce website’s online procedures or by request via email. Accepted payment methods are exclusively as follows:

  • Advance bank transfer;
  • Credit card, through a secure payment platform (Stripe).

On the e-commerce website and any other payment method indicated as valid by Ligyes srl from time to time via its website.

The order form will be archived in Ligyes srl’s database for the time necessary to execute it and, in any case, according to legal terms. The user will be able to access the order form and/or related data through their personal account.
The sale prices of the products illustrated on the website include VAT. Delivery charges are indicated separately in a specific section, vary depending on the nature of the shipment, and refer to the public sales price list.

Delivery and Product Availability
The delivery of products occurs at the address indicated by the customer within 7 working days in Italy or 15 days for the European territory, from the conclusion of the contract via express courier.

Ligyes srl accepts customer orders within the limits of the quantities of requested products available in stock. Therefore, Ligyes srl’s acceptance of the customer’s purchase proposal is subject to the availability of the products in stock.

Ligyes srl commits to promptly inform the customer of any stock shortages due to excessive demand or other causes.

If a product is unavailable, the Supplier will promptly notify the Customer within seven working days of receiving the order.

The Supplier will refund the Customer any amounts already paid for the value of the unavailable goods unless the Customer expressly agrees to replace the product with another of equivalent or superior value and quality. In any case, the Supplier will send the available goods and/or the substituted items, maintaining unchanged the transport costs indicated in the original order.

Exclusion of Liability
The Supplier assumes no responsibility for non-performance or delayed performance of the contract due to force majeure, unforeseen circumstances, or internet service disruptions that prevent, in whole or in part, execution of the contract within the agreed times.

The Supplier is not responsible for damages, losses, and costs incurred by the Customer in case of non-performance of the contract for reasons not attributable to it and/or due to the unavailability of the ordered product, as the Customer has the sole right to a refund of the amounts paid.

Similarly, the Supplier is not liable for any fraudulent or illegal use by third parties of credit cards and other payment methods during the payment for the purchased products. In fact, at no point in the purchase process does the Supplier have access to the Customer’s credit card number, which is transmitted directly to the banking institution managing the service through a secure connection.

Complaints
Any complaints may be sent via email to: info@ligyes.com. Complaints must be sent within 3 days of receiving the product, indicating the nature of the complaint and including a photo of the product.

Warranties and Assistance

For the products purchased by the customer, the rules regarding warranties and assistance for the sale of consumer goods apply.

Customer Obligations
The customer declares and guarantees: that they are a consumer as defined in Article 3 of the Consumer Code; that they are of legal age; that the data provided for the execution of the contract are correct and truthful.

Applicable Law and Jurisdiction
The sales contract with Ligyes SRL is concluded in Italy and is governed by Italian law. Any dispute regarding the application, execution, interpretation, and violation of the purchase contracts made “online” via the website www.ligyes.com and www.ligyes.it is subject to Italian jurisdiction, and the competent court will be the court of residence or elected domicile of the Customer, if located within the territory of the State. In all other cases, the court of Genoa (GE) will be competent.
